By means of this writ petition the petitioner, which is a firm, has come to this Court submitting that it participated in the bid for mining of a particular area, mentioned at page 29 of the writ petition (Annexure 2 to the writ petition), by E-Tender notice dated 7.9.2017. The area of the land was described as 4 hectare.
Learned counsel for the petitioner submits that upon inspection it was found that no mining operation can be done in major part of the plot as the same is covered with water and the petitioner has filed his objection after his bid being highest being accepted by the authorities.
Learned Standing Counsel on the other hand submits that an environment clearance certificate is also required for mining, which has not been given to the petitioner and without environment clearance certificate no mining can be done by the petitioner.
The petitioner submits that it has already moved an application for the same but the same is pending.
The writ petition is disposed of with the observation that the respondent no. 3 may consider the claim of the petitioner with regard to environment clearance certificate and pass appropriate orders, as far as possible, within two months form the date a certified copy of this order is presented before it.
