ORDER:
This Civil Revision Petition arises out of order dated 1- 3-2014 in I.A.No.129 of 2012 in O.S.No.39 of 2006 on the file of the Motor Accidents Claims Tribunal-cum-XI Additional District Judge (FTC), Ranga Reddy District.
At the outset, it needs to be noted that the order under revision contains a mistake relating to the year of the I.A. A perusal of the record shows that the I.A. was dated 17-2- 2014, from which it is clear that the same is of the year 2014 and not of the year 2012. Be that as it may, by the above mentioned order, the lower Court has set-aside the order passed against the respondents setting them exparte.
In my opinion, the lower Court has exercised sound discretion in setting aside the exparte order to enable the respondents to cross-examine PW-1 and contest the suit on merits. Therefore, I do not find any reason to interfere with the order of the lower Court.
The Civil Revision Petition is accordingly dismissed.
As a sequel to the dismissal of the Civil Revision Petition, CRPMP No.2504 of 2014 filed for interim relief is disposed of as infructuous.
