JUDGMENT / ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the third respondent not to grant license to the fifth respondent so as to extend burial ground in Survey No.A2-25/3, Vadasery Village, Kanyakumari District, by way of issuing a writ of mandamus.
2.The learned counsel appearing for the third respondent has submitted to the effect that there is no move on the part of the fifth respondent for getting license so as to extend burial ground and further a representation has already been given and the same has been considered and the third respondent has passed a suitable order.
3.In fact this Court has perused the same and ultimately found that the third respondent has not stated anything about the alleged extension of burial ground in the survey number mentioned in the petition and therefore this Court is of the view that the present writ petition is totally unwarranted and the same deserves to be dismissed.
4.In fine, this writ petition is dismissed without costs. Consequently, connected Miscellaneous Petition is dismissed.
