The petitioner has obtained a decree in O.S. No. 170/2009 on the file of the court of the Munsiff of Varkala restraining the respondent from interfering with her peaceful possession and enjoyment of the property. The petitioner has also been permitted under the decree to construct a compound wall along the boundary fixed through the process of court. The respondent has however filed I.A. No. 513/2013 seeking to set aside the ex-parte decree which is still pending. The petitioner seeks an early consideration of the said interlocutory application in order to give a quiteous to the issue.
2. I direct the court of the Munsiff of Varkala to dispose of I.A. No. 513/2013 in O.S. No. 170/2009 on its file expeditiously. Every endeavour shall be made to pass final orders thereon within a period of two months from the date of production of a copy of this judgment.
The Original Petition is disposed of.
