THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION No. 305 of 2012 ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) Report in terms of our order dated 11.11.2013, has been submitted. From the said report we noticed that various measures have been taken to ensure road safety and to prevent road accidents. It appears that at the District level a Road Safety Committee has been constituted and this Committee has to sit and hold a meeting once in a month to assess the situation.
From the affidavit it appears that the Road Safety Committee at the District level is not sitting regularly, as required to be held. We are of the view that at the moment if the measures, as has been outlined in the report, are implemented, then the road safety can be ensured to a great extent so much so road accidents can be prevented and minimized. But, this requires constant effort with regular sitting of the Road Safety Committees at the District level. We therefore direct the Principal Secretary, Transport Department, to monitor that the Committees at the District level sit regularly and effectively implement the measures adopted by the Government as indicated in the report. In the event any of the Road Safety Committees at District level fail to do so, then the Principal Secretary shall take all disciplinary measures against such Committees. We also direct the respective District level Road Safety Committees to sit regularly in terms of the guidelines and scheme laid down by the Government in terms of the State Road Safety Council. In case of non-compliance of this order, it would be open for the petitioner to approach this Court with an appropriate proceeding.
The public interest litigation is accordingly disposed of. No order as to costs. Miscellaneous petitions, if any pending, shall stand disposed of.
