Heard learned counsel for the applicant and learned A.G.A. for the State.
By way of the instant application, the applicant has prayed for a direction to the Additional Chief Metropolitan Magistrate, 9th, Kanpur Nagar, in Case No.1930 of 2018, M/s House through Proprietor Rama Kant Gupta Vs. Ms. Medicos Chemist, under Section 138 Negotiable Instruments Act, 1881 expeditiously.
In this case, the applicant wants expeditious disposal of the aforesaid case.
I have considered the submissions advanced by learned counsel for the applicant and perused the record.
Obviously, the court below is under obligation to expedite the proceeding adhering to the provision of Section 309 Cr.P.C. and decide the case within the stipulated time as mandated under the special Act. Therefore, no order need be passed by this Court.
Consequently, this application is disposed of.
