Heard learned counsel for the petitioners and learned Standing Counsel for the State respondents.
By means of the present writ petition, the petitioners have prayed for a direction in the nature of mandamus directing the State-respondents to give them protection so that the private respondent may not interfere in their peaceful marital life. It is stated that their marriage was solemnized on 20.4.2019. The record of the case reveals that they are major. No F.I.R. has been registered against them.
The record further reveals that the petitioners have approached the police when the private respondent caused interference in their marital life.
Learned Standing Counsel states that as per the Government Order dated 31.8.2019, if the petitioners approach the police, requisite protection shall be given to them.
Under such circumstances, a direction is being issued that as and when the petitioners approach the police, requisite protection would be given to the petitioners under the Government Order dated 31.8.2019. The petitioners would get their marriage registered under the Uttar Pradesh Marriage Registration Rules, 2017 within a period of two months. It is made clear that if the petitioners fail to get their marriage registered within the aforesaid period, the protection provided shall automatically stand withdrawn.
If the petitioners feel that the protection granted by the police is not sufficient, they may again approach the High Court.
No notice is being issued to the private parties. However, if they find that any false averment has been made in this writ petition, they can file for the recall of the order.
The writ petition is, accordingly, disposed of.
