Heard learned counsel for the petitioner, learned AGA and perused the record.
By means of the present Hebeas Corpus petition the petitioner has made a prayer to issue a direction to all the private respondents to produce the corpus namely Fool Singh (petitioner no. 1) before this Court.
Submission made by learned counsel for the petitioner that this is a family dispute between the brothers i.e. Fool Singh in one hand and Ramdev, Jog Singh, Surendra and Umesh on the other. They are inter se siblings of Chhatra Singh. There is a dispute among brothers regarding 5 Bighas of land. This habeas corpus petition is filed on behalf of Smt. Rajwati Devi W/o Fool Singh. It has been stated that on account of animosity among the brothers, her husband was illegally detained by the aforesaid respondents since 13.08.2019. The poor lady is running from pillar to post to get the FIR registered and the police authorities are not paid any heed of her request. It is further submitted that number of affidavits given to the police authorities on the different occasions but neither her husband was recovered not the police has registered any FIR.
Under the circumstances, the S.S.P., Bulandshahr and S.H.O., P.S. Ahmadgarh, District Bulandshahr are directed to look into the matter and carry out an extensive search regarding the whereabouts of Fool Singh and take suitable legal action against erring respondents, if their active complicity is found in this episode.
With this observation, the present habeas corpus petition stands disposed of.
Copy of this order may be given to learned AGA for communication and necessary compliance within a period of 15 days.
