This Writ Petition is filed for the following substantive relief:
“to issue a Writ or Direction more particularly one in the Writ of Mandamus, declaring the action of respondents 2 & 3 for not disposing of the appeal filed U/S. 76 (1) of the Coop. Societies Act, filed by the writ petitioner- society as illegal, arbitrary, unconstitutional and violative of principles of natural justice, consequently, direction may be issued to respondents 2 & 3 to dispose of the appeal filed U/s.
76 (1) of the Coop. Societies Act, before the 2nd respondent, which was filed by the writ petitioner society on 3.7.2014; further the 1st respondent cannot insist for implementation of the orders in Proc.No.32/C/2013 dt. 6.1.2014, till the appeal filed U/S. 76 (1) of the A.P.Coop. Society Act is disposed of by respondents 2 & 3.”
After arguing the case, Mr.T.Sudhakar Reddy, learned Counsel for the petitioner, requested for permission of the Court to withdraw the Writ Petition with liberty to the petitioner to pursue the appeal stated to have been filed before the Andhra Pradesh Co-operative Tribunal under Section 76 of the Co-operative Societies Act, 1964.
The request of the learned Counsel for the petitioner is accepted and the Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel, WPMP.No.32806 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
