HON’BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.8692 of 2007
Date: September 04, 2014
Between:

… Petitioner And
1. Assistant Director Fisheries, Medak, Medak District & another.
… Respondents * * * HON’BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.8692 of 2007
O R D E R:
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Fisheries.
2. This writ petition was filed challenging the proceedings of the first respondent, vide Letter No.129/D/2007 dated 21.03.2007, which was received by the petitioner society on 16.04.2007. Under the impugned proceedings the first respondent directed the petitioner society to admit 29 fishermen as per the list enclosed to the letter as members of the society as per the provisions of the bye-laws of the society by collecting shares and admission fee and intimate the same to the first respondent.
3. The petitioner society convened a General Body meeting on 17.04.2007 and rejected the application of B. Nagaiah and it passed a resolution to the effect that they also agreed to authorize the President and Secretary to write letters to the first respondent regarding rejection of membership. The said B. Nagaiah is one of the persons whose name was included in the list of members recommended by the first respondent. Action was taken in the year 2007, but rejected the membership of the persons whose names were recommended by the first respondent. If any person was aggrieved by such action, he is entitled to take appropriate remedies in view of the provisions of the A.P. Cooperative Societies Act.
4. In view of the rejection of membership of the persons proposed by the first respondent and since the General Body is the ultimate authority with regard to admission of members, the grievance of the petitioner society challenging the proceedings of the first respondent dated 21.03.2007 does not survive.
5. The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
