1.Heard Mr. Mehul S. Shah learned counsel for the appellant.
2.This appeal is directed against the judgement and award passed under Section 163A of the Motor Vehicles Act in M.A.C.Petition No.865 of 1999 by the M.A.C.Tribunal (Main), Kuttch at Bhuj, whereby the Tribunal has awarded Rs.4,89,500/-.
3.It is stated by Mr. Shah learned counsel for the appellant that he would like to proceed with the application under Section 166 of the Act pending before the Tribunal and appellant be permitted to withdraw his application under Section 163A of the Act in which the impugned judgement and award has been passed.
4.In view of the above, application under Section 163A of the Act is permitted to be withdrawn and disposed of as having become redundant.
