The wife has filed O.P. No. 1445/2013 on the file of the Family Court, Kollam for recovery of gold ornaments and money. The husband seeks transfer of the case from the Family Court, Kollam to the Family Court, Ernakulam on the ground that both of them are now working at Ernakulam.
2. It transpires that the parents of the wife are at Kollam who look after the child born in the wedlock. It is also reported that the wife resides with her friends only at Ernakulam for the sake of employment.
3. There will be practical difficulty for the wife to handle the case alone if the case is transferred from the Family Court, Kollam to the Family Court, Ernakulam. Other marital disputes are also pending on the file of the courts at Kollam. It will be inequitable therefore to order transfer of cases as sought.
The Transfer Petition is dismissed.
