The petitioner take exception to the order dated 23.10.2020 passed by District Magistrate in purported exercise of power under sub-section (2) of Section 14 of the The U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986.
It being not disputed by the learned counsel for the petitioner that the impugned order is appealable under Section 18 of the Act of 1986.
In view whereof, we relegate the petitioner to avail the same. In case if the appeal is preferred within a period of 30 days' from today, the Appellate Authority shall dwell upon the same rather throw it over board on the ground of limitation.
We make it clear that we have not expressed any opinion on the merits of the matter.
Petition stands disposed of finally in above terms.
