Court No. - 33
Case :- WRIT - A No. - 13444 of 2020 Petitioner :- Firdosh Begam Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Pramod Kumar Singh Counsel for Respondent :- C.S.C.
Hon'ble Ashwani Kumar Mishra,J.
Notices issued to petitioner dated 27.10.2020 and 12.12.2020 to vacate the premises are assailed in this petition. Records reveal that the petitioner's husband has died long back. Despite repeated notices issued, petitioner has not vacated the premises.
There is absolutely no justification to allow the petitioner to continue in possession of the house any further and, therefore, the notice under challenge merits no interference.
Various personal difficulties are however disclosed including Covid-19 Pandemic and learned counsel for the petitioner undertakes that the petitioner shall vacate the premises positively within a month.
In view of the specific statement made by the learned counsel for the petitioner, the petitioner is permitted to remain in occupation of the premises till 15.2.2021 and it shall be open for the authorities to get the accommodation vacated thereafter in the event petitioner fails to honour her undertaking, in accordance with law.
Subject to the above observations, writ petition stands disposed of.
