Heard Sri Yogendra Pal Singh, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This bail application has been moved on behalf of the applicant in Case Crime No.11 of 2019 under section 3, 4, 5, 7, 8 The Immoral Traffic (Prevention) Act, 1956 PS.Anti Human Trafficking Unit, District Meerut.
Learned counsel for the applicant has submitted that the applicant is innocent lady. She alongwith her daughter had visited the said hotel for dinner and has been falsely implicated in the offence on the basis of suspicion. She has no concern with such type of activities. There is no criminal history against her. Applicant is languishing in custody since 17.7.2019. Learned counsel for the applicant further undertakes that if the applicant is released on bail, she will not misuse the liberty of bail.
Learned A.G.A. opposed the prayer of bail and submitted that the applicant is named in the First Information Report and was apprehended on the spot. She was involved in offence of prostitution, hence she is not entitled for bail.
Considering the submission of learned counsel for the parties, facts of the case, nature of allegation, gravity of offence, without expressing any view on on the merits of the case, the Court is of the opinion that it is a fit case for bail. Hence, the bail application is hereby allowed.
Let the applicant- Smt. Firdaus Khan be released on bail in Case Crime No.11 of 2019 under section 3, 4, 5, 7, 8 The Immoral Traffic (Prevention) Act, 1956 PS.Anti Human Trafficking Unit, District Meerut. on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned, subject to following conditions:-
(i) The applicant will not tamper with prosecution evidence.
(ii) The applicant will abide the orders of court, will attend the court on every date and will not delay the disposal of trial in any manner whatsoever.
(iii) The applicant will not indulge in any unlawful activities.
(iv) The applicant will not misuse the liberty of bail in any manner whatsoever.
The identity, status and residential proof of sureties will be verified by court concerned and in case of breach of any of the conditions mentioned above, court concerned will be at liberty to cancel the bail and send the applicant to prison.
