(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) By this public interest litigation, the petitioner has prayed for a writ of mandamus directing the respondent authority to stop the activities of respondent No.12 of establishing the industrial unit at village Nani Tambadi, Dist. Valsad and to initiate appropriate action against respondent No.12 for the breaches committed by such unit. Mr. Thakore, learned Senior Advocate appearing on behalf of respondent No.12 submits that although his client got subsequent permission from the appropriate authority, they have ultimately decided to abandon the said project.
In view of such stand taken by Mr. Thakore, we direct respondent No.12 to affirm an affidavit stating that it has decided to abandon the project. Let this affidavit be given within a week. Let this matter appear on April 19, 2012 along with SCA No. 6233 of 2010.
