(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) In view of the stand taken by respondent No.12 as disclosed in their affidavit, when they have decided to abandon the proposed plan of project, in our view no purpose will be served by keeping this PIL pending. We accordingly dismiss this application. We however, make it clear that we have not gone into the merit of this case and dismissal of this application will not stand in the way of the parties in making appropriate submission, if similar type of dispute arises in future.
In view of this order, the connected Civil Application has become infructuous and stands disposed of accordingly.
