JUDGMENT / ORDER

The petitioner has approached this Court seeking the following reliefs: i) To issue a writ of mandamus or any other appropriate writ, direction or order, commanding the respondents to refix the selling price of sand per ton covering the minimum cost of Rs.1130/-
ii) To direct the 2nd respondent to consider and pass orders on Ext.P11 representation after hearing the petitioner and other 2 Societies engaged in manual dredging.
2. The petitioner complains about re-fixation of the selling price of the sand. Apparently this is a case in which the petitioner challenges the fixation of price selling by the 3rd respondent. It is the lowest selling price quoted by other tenderers. According to the petitioner, the procedure adopted for the fixation of price of sand is not justifiable as that it is without taking into consideration the actual expenses involved in the matter and accordingly unworkable. This Court in a writ petition cannot decide on the pros and cons by which the authorities concerned fixes the selling price. Admittedly, the procedure now adopted is based on the lowest quoted rate which under normal circumstances is acceptable. Petitioner W.P.(C) No.13169 OF 2014 2 had submitted Ext.P11 representation before the second respondent. At present there can only be a direction to the second respondent to consider Ext.P11 and pass appropriate orders.
In the result, this writ peition is disposed of directing the second respondent to consider and pass appropriate orders on Ext.P11 representation within a period of two months from the date of receipt of a copy of this judgment.
