By order dated 07.05.2019 was passed by the Deputy Director Consolidation, Varanasi in Revision No. 96, Abhishek Vs. Arun Kumar, Revision No.98 Shiv Murat Mishra Vs. Fekana Devi and Revision No. 99 Fekana Devi Vs. Keshav and others. The order dated 07.05.2019 remands the matter to the appellate court for deciding the controversy on merits consistent with the provisions of Section 19 of the U.P. Consolidation of Land Holdings Act.
The only submission made by learned counsel for the petitioner Sri Prashant Sharma is that on the foot of the order passed by the Settlement Officer Consolidation, Varanasi the petitioner was inducted in possession in the reallotted Chak. Her possession is being threatened.
If that be the case, it is open to the petitioner to move an application for interim relief before the learned appellate court. In case the application for interim relief is submitted by the petitioner, the appellate court shall decide the same in accordance with law within a period of one month from the date of receipt of a certified copy of this order.
The writ petition is disposed of finally.
