This revision is listed peremptorily today. List has been revised. None appears on behalf of the revisionist. Shri Manu Chaudhary, learned counsel for the opposite party has sent illness slip, despite the case is being listed peremptorily.
Heard learned A.G.A. and perused the record.
This revision has been filed against the judgement and order dated 23.5.2006 passed by Additional Sessions Judge/Special Judge, Chandauli in S.T. No.
100 of 2001(State Vs. Marachhu & others) whereby opposite party nos. 2 to 9 have been acquitted from the charges under sections 147, 323/149, 325/149, 504, 506(2) I.P.C.
Perusal of the judgement of the court below shows that court below has recorded the findings that the allegations in this case have not been proved. The case was lodged as 'Peshbandi' in order to create defence.No offence has been proved against the accuseds in this case and alleged incident does not appears to be proved.
In view of the above impugned judgement and order does not suffers from any illegality, infirmity or jurisdictional error requiring any interference by this court.The revision lacks merit and is liable to be dismissed.
Hence revision is accordingly dismissed Order Date :- 23.8.2018 Atul kr. sri.
