Heard learned counsel for the petitioner and Shri Gaurav Kumar Chaturvedi for the respondent no.3, Nagar Palika Parishad Mugra Badshahpur as also learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"I) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.2 to decide the Case No.T201814360305778 (Amit Kumar Vs. Nagar Palika & others) u/s 24 of U.P. Revenue Code, 2006, pending before Sub- Divisional Magistrate, Tehsil Machhali Shahar, District Jaunpur (Annexure No.1) to this writ petition with in stipulated period at an early date as may be fixed by this Hon'ble Court."
It has been submitted that the proceedings under Section 24 of the U.P. Revenue Code, 2006 instituted by the petitioner in November 2018 has not been concluded till date.
Perusal of the order sheet appended along with the writ petition reveals that as many as 8 dates have been fixed in the matter since it was instituted. On 6 out of these 8 dates, the matter had been adjourned on account of lawyers being on strike.
Under the circumstances, this writ petition is disposed of directing the respondent no.2, Sub Divisional Magistrate, Tehsil Machhali Shahar, District Jaunpur to endeavour to decide the case of the petitioner, expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
However, it is directed that the court concerned, respondent no.2 need not comply with the directions contained in this order, in case, the lawyers continue to be on strike.
