JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) The short question arises for consideration is whether the inquiry is to be conducted after issuing the notice under Section 57(1) of the Gujarat Panchayats Act, 1993, or first inquiry is to be made. Since there is no factual dispute and legal question is involved in the appeal, learned counsel appearing for the parties agreed that the appeal itself may be finally decided.
ADMIT.
Learned AGP Ms.Jirga Jhaveri waives service of notice of admission on behalf of respondent No.1, learned counsel Mr.H.S.Munshaw waives service of notice of admission on behalf of respondent No.2 and learned counsel Mr.Mahendra Patel waives service of notice of admission on behalf of respondent No.4. Meanwhile learned counsel for the appellant shall file affidavit-in-rejoinder.
List this appeal for admission/final disposal on 12th April, 2012. Direct service for respondent No.3 is permitted.
