Heard Shri Virendra Singh holding brief of Shri Binod Kumar Tripathi, learned counsel for the applicants and Shri Jhamman Ram, learned AGA appearing for the State Opposite party.
The present application under section 482 Cr.P.C. has been filed seeking to quash the charge sheet no. 013/2019 dated 29.06.2019, arising out of Case Crime No. 105 of 2019, under section 323, 324, 325, 452, 504 and 506 I.P.C, Police Station- Nidhauli Kalan, District-Etah.
Counsel for the applicants after making submissions to some extent fairly submits that in the necessary ingredients for invocation of section 482 Cr.P.C. are not made out in the facts of the present case and accordingly, he does not wish to press the reliefs in the application. The reliefs sought are therefore, not entertained.
Learned counsel states that the applicants would submit to the jurisdiction of the court below and seek bail.
In case any such application for bail is moved by the applicants, the court below would be expected to dispose of the same in accordance with the settled principles of law.
Subject to aforesaid observation, the application stands dismissed.
