The husband has filed O.P. No. 186/2013 on the file of the Family Court, Kalpetta for custody of the child. A divorce has already been effected and the husband has reportedly remarried. The wife is residing with her parents at Malappuram. The husband employed abroad belongs to Wayanad.
2. It is a virtual impossibility for the wife to travel all the way from Malappuram to Wayanad for the conduct of the case. This is especially so since she has to look after the child aged 1½ years born in the wedlock. It may only be a slight inconvenience for the husband to travel from Wayanad to Malappuram for this purpose.
3. I therefore order transfer of O.P. No. 186/2013 from the Family Court, Kalpetta to the Family Court, Malappuram. The transferee court shall conduct a series of conciliatory talks before entering into the trial. Every endeavour shall be made to dispose of the case within a period of six months from today.
The Transfer Petition is allowed. No costs.
