BELOW NOTE FOR SPEAKING TO MINUTES Heard Mr. Saiyed, learned advocate for the petitioner, who has taken out present Note for Speaking to Minutes.
2. Mr. Saiyed, learned advocate for the petitioner, has submitted that there is error in mentioning the figure in 6th line of paragraph no.4, inasmuch as instead of Rs.1.20 lacs, inadvertently, Rs.1.60 lacs is mentioned.
He submitted that the petitioner has deposited the sum of Rs.1.20 lacs until now.
2.1 Therefore, it is directed that in 6th line of paragraph no.4, necessary and appropriate correction may be made so as to reflect Rs.1.20 lacs instead of Rs.1.60 lacs .
3. Mr. Saiyed, learned advocate for the petitioner, also submitted that in view of the directions to make total deposit to the extent of Rs.2,50,000/- (out of total sum of Rs.3,86,000/- which are in arrears), the petitioner shall have to deposit further sum of Rs.1.30 lacs and the said aspect may be clarified in the order. Mr. Saiyed, learned advocate for the petitioner, further submitted that request for appropriate installments was also made, however, it is not reflected in the order.
3.1 Therefore, it is directed that below mentioned line may be added at the end of paragraph no.5 on page no.3.
In compliance of above mentioned directions, the petitioner shall deposit balance amount of Rs.1.30 lacs in two equal installments, i.e. Rs.65,000/- on or before 7.1.2013 and balance Rs.65,000/- on or before 31.1.2013.
3.2 Therefore, it is clarified that the petitioner shall deposit the said amount of Rs.1.30 lacs in two equal installments, as aforesaid.
Necessary corrections/amendment, as mentioned above, be made in the order dated 5.12.2012 passed in present petition.
With the aforesaid clarifications and direction, the Note for Speaking to Minutes dated 19.12.2012 accordingly stands disposed of.
