JUDGMENT / ORDER

Petitioners are accused Nos.2 and 3, in Crime No.426 of 2014 of the Kasaragod Police Station for the offence punishable under Sec.395 of the Indian Penal Code, are in custody from 25.04.2014 and seek bail.
2. Learned Public Prosecutor has opposed the application.
It is submitted that on 25.04.2014 at about 12.30p.m, accused persons summoned the de facto complainant to Kasaragod, took him to a room, took his photographs in nude form and `17,000/-, his watch and mobile phone were forcibly taken from him. These petitioners demanded Rs.8,00,000/- from the de facto complainant. Accused Nos.1 and 4 are to be arrested and accused Nos.6 and 7 are to be identified.
3. Learned counsel submits that the allegations are not true. According to the learned counsel, FIS does not even mention presence of the petitioners at the time and place of the incident
4. In the nature of the allegations made against the petitioners and investigation required to be done, request for bail cannot be allowed at this stage.
B.A.No.3537 of 2014 2 The application is dismissed without prejudice to the petitioner moving again after the investigation has progressed.
