RESPONDENT THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE RESPONDENT HEREIN TO ACCEPT THE REPRESENTATION DATED 18.01.2019 AND 16.08.2019 VIDE ANNEXURE-E AND G RESPECTIVELY, BY IGNORING THE MEMO ISSUED BY THE RESPONDENT DATED 20.07.2019.
THIS WRIT PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Sri Vijaykumar A. Patil, learned Additional Government Advocate for the respondent, on instructions, submits that, the complaint has to be accompanied by the affidavit of the complainant, in view of the Circular issued by the Hon’ble Supreme Court. He submits that the complaint dated 18.01.2019 made by the petitioner has not been accompanied by his affidavit. Therefore, Memo dated 20.07.2019 came to be issued informing the petitioner/complainant that his complaint has been registered and attended in HVC 17/2019(JO) and the same has been filed vide Order dated 04.02.2019 of the Hon’ble Acting Chief Justice.
2. At this stage, Sri N.P.Amruthesh, learned counsel for the petitioner submits that liberty may be reserved to the petitioner to file a fresh complaint after following the procedure as contemplated under the Circular issued by the Hon’ble Supreme Court.
3. The submission is placed on record.
4. The writ petition is disposed off with liberty to the petitioner to lodge a fresh complaint after complying the procedure contemplated under the Circular issued by the Hon’ble Supreme Court. It is made clear that this Court has not expressed any opinion on merits of the matter while disposing off the present writ petition.
