Heard learned counsel for the applicants and learned A.G.A. for the State.
The present anticipatory bail application has been filed by the applicants- Farmud, Jahn Mohammad and Mazid in Case Crime No. 723 of 2018, under Sections 147, 148, 149, 452, 504, 323, 307, 336 I.P.C., Police Station- Tanda, District- Rampur with the prayer to grant anticipatory bail to them.
I have perused the averments made in the first information report, the order by means of which the anticipatory bail application has been rejected by the court below as well as the material placed on record.
Learned counsel for the applicants has submitted that the parties have compromised the matter and in this behalf the injured has also filed an affidavit. The applicants are ready to cooperate with the investigation. Therefore, the applicants may be enlarged on anticipatory bail.
Per contra, learned A.G.A. has strongly opposed the prayer for anticipatory bail and submitted that specific role of firing has been given to the applicants and the factum of compromise cannot be taken into account at this stage at the back of first informant and the injured.
After hearing learned counsel for the parties and after perusing the allegations made in the first information report and also looking to the seriousness of the allegation as made in the FIR, gravity of offence and the severity of punishment and the facts as advanced by the learned A.G.A., no case for grant of any indulgence is made out.
Accordingly, the application for anticipatory bail is rejected.
