(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the marriage of his brother scheduled on 25th April, 2012.
From jail remarks, we find that on earlier occasion, the applicant-convict was permitted to attend the marriage of his sister under police escort.
Considering the totality of the facts, it is ordered that present applicant-convict shall be permitted to attend the marriage of his brother scheduled on 25th April, 2012 under police escort with one armed ASI and two armed Police Constables at his cost.
It is ordered that the applicant-convict shall be permitted to go out on 24th April, 2012 and shall surrender on 26th April, 2012. It is clarified that this order shall be effected only after the applicant deposits the amount as may be ordered by the jail authorities for police escort.
It is clarified that it shall be the duties of escorting officer to see to it that custody of the applicant is maintained with them properly and the applicant shall be lodged with the jail authority on 26th April, 2012 as ordered above.
Application is allowed accordingly. Rule made absolute. Direct service today is permitted.
