Respondent No.2 is served by affixing the notice issued by this Court and learned advocate for respondent No.3-Insurance Company has filed sick note.
Upon consideration of the grounds stated for delay in filing the appeal under Section 173 of Motor Vehicles Act due to financial constraints on the part of the claimants/applicants herein and sufficient cause being shown on oath, I am inclined to condone the delay of 121 days caused in filing this appeal and accordingly, Civil Application is allowed in terms of prayers 10 (a) and (b) of this application.
Rule is made absolute.
