JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) On 02.03.2011, learned AGP placed on record rough calculation of the applicant's pensionery benefits. As per such statement, the applicant was entitled to receive a sum of Rs. 10,85,566/-.
Learned AGP today placed on record order dated 20.03.2012 passed in Letters Patent Appeal No. 568 of 2012 in Special Civil Application No. 9143 of 2011. Order of the Court reads as under:
"Learned AGP sought time to take instruction as regards the calculation of amount due to the petitioner, by way of retiral benefits upon demise of her husband, and as far as may be deposit that amount with the registry of this Court by the next date of hearing. Failing that learned AGP is requested to see that Principal Secretary, Revenue Department, Government of Gujarat, shall remain personally present before the Court to explain as to why two successive orders of this Court are not implemented for months together and why an interim order directing payment to the respondent should not be made. S.O. to 29th March 2012, as suggested by learned AGP.
Learned AGP, under instructions, of Mr. P.H.Gharasia, Under Secretary, who is present in the Court, stated that the authorities will be depositing the entire amount before the Registry of this Court, as directed by the Division Bench in the order dated 20.03.2012.
When the Government is in the process of depositing the entire pensionery benefits before the Registry of this Court and when Division Bench of this Court is monitoring such deposit, we do not find any reason to take further contempt proceedings against any of the respondents.
In the result this contempt petition is disposed of.
