1. The present application is filed by the convict through jail seeking temporary bail for a period of 45 days so as to get himself operated for stones in both his kidneys.
2. Learned APP Mr.H.K.Patel invited attention of the Court to the jail remarks and also to a certificate issued by the Medical Officer, Central Jail Dispensary, Ahmedabad, which reads as under:-
"..... He is having complaint of pain in abdomen. For his complaint, he was examined by fulltime general surgeon and advised USG Kub and the same was carried out on Dtd.06/06/2012 by Radiologist of Civil Hospital Ahmedabad during camp at jail dispensary and the report suggested "Middle & lower calyceal calculus measuring 4.5 mm size in Rt.kidney and middle calyceal calculus measuring 4mm in Lt.kidney.
Considering the report he was advised to take plenty of fluid and medicines by General Surgeon of jail dispensary....."
3. From the jail records, it is noticed that the convict was out in the month of January 2011 for the treatment of his daughter, in the month of March-May 2011 for kidney operation of his mother and in the month of May-June 2012 for the operation of brain of his father.
4. Taking into consideration the jail record, no case is made out for grant of temporary bail. Hence, the application is rejected.
