Heard the learned counsel for the applicant and the learned AGA for the State and perused the record.
This application has been filed by the applicant, Farid Alvi, to direct the courts below to decide the bail application of the applicant on same day in case crime no. 376 of 2008, under sections 420, 506 IPC, P.S. Meerapur, District Muzaffar Nagar.
It seems that the applicant is already on bail for the offence under 420 and 506 IPC, in case crime no. 376 IPC, vide the order dated 5.9.2008 of this Court in bail application no. 24384 of 2008. It is further submitted that at the time of submission of charge sheet section 406 IPC was added.
Looking into the entire facts and circumstances of the case, I am of the view that the courts below be directed to hear the bail application of the applicant for offence 406 IPC too expeditiously preferly on the same day if the applicant sufrrnders and moves the bail application within three weeks.
With these observations this application id disposed of accordingly.
