The present contempt petition has been filed for flouting the interim order dated 15.04.2014.
A counter affidavit has been filed on behalf of the opposite party stating that they have filed counter affidavit along with stay vacation application in writ petition in 2014, however, till date, no rejoinder affidavit has been filed by the applicant.
It is further submitted that the applicant had obtained intermediate certificate from Jamia Milia Islamia, New Delhi in 1995 and graduation certificate from Jamia Urdu Aligarh in same year i.e. 1995. In view thereof, the opposite party submits that it would not be in the interest of justice to comply the interim order.
The applicant has not refuted the facts stated in para 4 of the counter affidavit.
In my opinion, there is no wilful and deliberate disobedience on the part of the opposite party.
The contempt petition is accordingly dismissed with liberty to the applicant to pursue the writ petition.
Notice, if any, stands discharged.
