Heard learned advocate for the applicant-original accused no.1 and Mr.N.J.Shah, learned Additional Public Prosecutor for the respondent-State.
In this application, the request is made by the applicant to extend the interim anticipatory bail till the next date of hearing or till the final disposal of the application for interim bail in view of the order dated 11.05.2012, passed by the learned Judge (Coram:M.D.Shah,J.) by which considering the facts and circumstances of the case about the examinations in which the applicant wants to appear, and therefore, Investigating Officer was directed not to arrest the applicant till 24.05.2012 . Due to summer vacation, in this Court, the applicant has filed a note. Accordingly, submissions are made by Registry before the Hon'ble the Acting Chief Justice and this application is permitted to be listed and heard by this Court.
Considering the over all facts and circumstances of the case, I am inclined to direct the Investigating Officer not to arrest the applicant till 18.06.2012 on the same terms and conditions.
With the aforesaid, this application is allowed. Direct service is permitted.
