Heard Sri Mohd. Samiuzzaman Khan, learned counsel for the applicant and Sri Karunakar Singh, learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed for a directing the concerned Court below to execute the proceedings for arresting the opposite party nos.4 to 6 and send them in jail who are main accused in pursuance of the N.B.W. as well as 82/83 Cr.P.C. proceedings in Case No.48033 of 2016 (State Vs. Sayra and others) arising out of Case Crime No.1160 of 2016, under Sections 498-A, 323, 307 I.P.C. and Section 3/4 D.P. Act, Police Station Sahibabad, District Ghaziabad.
During the course of argument learned counsel for the applicant has confined his prayer to the extent that the suitable direction may be issued for expeditious disposal of the case.
No useful purpose would be served in keeping the petition pending, which is finally disposed of with a direction to learned Chief Judicial Magistrate, Ghaziabad to consider and decide the Case No.48033 of 2016 (State Vs. Sayra and others) arising out of Case Crime No.1160 of 2016, under Sections 498-A, 323, 307 I.P.C. and Section 3/4 D.P. Act, Police Station Sahibabad, District Ghaziabad, pending in the Court of learned Chief Judicial Magistrate, Ghaziabad, most expeditiously, preferably within a period of six months from the date of production of certified copy of this order, before concerned court below, in accordance with law, after hearing the concerned parties, without granting unnecessary adjournment to either of the party, in case the proceedings of the aforesaid case, is not stayed by any Court.
