Heard Shri Sanjay Kumar Srivastava, learned counsel for the petitioner, learned standing counsel for the State of U.P. and Shri Shekhar Gangal, learned counsel for respondent no. 4.
Shri Shekhar Gangal states that the petitioner has challenged the order dated 08.04.2019 in Writ C No. 17862 of 2019 (Farahim Vs. State of U.P. & 3 Others), which was dismissed by this Court vide order dated 23.05.2019.
In the order dated 23.05.2019, it has been specifically decided that the petitioner cannot be granted a licence to hold cattle market over the land owned by the petitioner as the land is situated in middle of the Abadi area. Thus, fresh application for grant of licence is not maintainable.
This writ petition has been filed concealing the material fact relating to filing of earlier Writ C No. 17862 of 2019. This fact could not be denied by the counsel for the petitioner.
The writ petition is accordingly dismissed for concealment of material fact relating to filing of Writ C No. 17862 of 2019 as well as its dismissal vide order dated 23.05.2019.
