(Per : HONOURABLE MR.JUSTICE A.L.DAVE) The corpus is produced before us. She states that her date of birth is 26.04.1994, which is found to be true from the documents produced by the petitioner as well. She states that she has an affair with respondent No.3 - Atul Dhanabhai alias Dhanajibhai Wadher and it is at her instance that they left their homes from Morbi. There was no element of force on part of respondent No.3.
The corpus states that her relationship with respondent No.3 was not approved by her parents and therefore, she was required to take this step. She wants to marry respondent No.3, but, is unable, because, she does not have documents of proof of her age and respondent No.3 is arrested. She does not want to go and stay with her parents, but, wants to stay with respondent No.3. She states that her relation with respondent No.3 is accepted by father and family members of respondent No.3. The corpus states that she wants to go and stay at the house of respondent No.3 at Vajepar, where, Atul's father is residing. She states that Atul's father has accepted this relationship.
Since the corpus is a major today, she is free to go wherever she likes. In view of this fact, corpus is not willing to go and stay with her parents. The petition, therefore, cannot be entertained, stands dismissed. Notice discharged.
