Heard Sri Gulab Chandra, learned counsel for the applicants, learned AGA for the State/opposite party no.1 and Sri Vijay Kumar Dwivedi, learned counsel appearing on behalf of the opposite party no.2.
The present application under Section 482 Cr.P.C. has been filed by the applicants with a prayer to call for and peruse the entire record related to case crime no. 291 of 2018, under Sections 498A, 323, 504, 506, 324, 313, 307 IPC and 3/4 D.P.
Act, Police Station Chharra, Distric Aligarh and set aside the impugned order dated 15.6.2019 passed by Deputy Superintendent of Police, whereby the direction has been given for further investigation in the matter.
Admittedly, the investigation is still pending and charge-sheet has yet not been submitted in this case, therefore, in view of Full Bench judgment of this case in case of Ram Lal Yadav and others Vs. State of U.P. and others 1989 Cr.L.J. 1013, the present application is not maintainable under Section 482 Cr.P.C.
On the request made by learned counsel for the applicants, the application is dismissed as withdrawn with liberty to file a fresh application before the appropriate forum.
