Heard learned counsel for the applicant and learned A.G.A for the State.
The instant anticipatory bail application has been filed on behalf of the applicant, Fakir Mohammad, with a prayer to release him on bail in Case Crime No. 1207 of 2019, under Sections- 420, 406, 506 I.P.C., Police Station- Kwarsi, District- Aligarh, during pendency of trial.
The allegations against the applicant show that he is involved in economic offences. The Apex Court in the case of Directorate of Enforcement Vs. Ashok Kumar Jain (1998) 2 SCC 105, has held that in economic offences, the accused is not entitled to anticipatory bail.
Learned A.G.A. has pointed out that applicant has criminal history of 4 cases. Hence, no ground is made out for grant of anticipatory bail to the applicant.
The anticipatory bail application is, accordingly, rejected.
