Counsel for Applicant :- Gopeshwar Sahai Bisaria Counsel for Opposite Party :- G.A.
Hon'ble Rahul Chaturvedi,J.
Heard learned counsel for the applicant, learned AGA and perused the record.
By means of this application, the applicant who is involved in case crime no. 98 of 2019, under Section 376 IPC, P.S. Meerganj, District- Bareilly is seeking enlargement on bail during the trial.
Learned counsel for the applicant in support of his application for bail submits that the applicant is innocent. He has been falsely implicated. It is further submitted that the FIR was registered by the victim herself under section 376 IPC with the allegation that the applicant has committed rape upon her and when she made a complaint, the applicant has extended a promise to perform nikah with her. It is further contended that on the promise of marriage, the victim consciously surrender herself before him and established physical relationship since 2017 with the applicant. In the statement of the victim recorded u/s 164 Cr.P.C., she has stated that she is aged about 24 and half years. She is a major girl, who is well aware of all the actions and its repercussions. She appears to be a consenting party of the entire episode. It is next submitted that the applicant is in jail since 01.04.2019 having no criminal antecedents except the present one.
Learned AGA opposed the prayer for bail but could not dispute the aforesaid facts and the legal submissions as argued by the learned counsel for the applicant.
Keeping in view the nature of the offence, evidence, complicity of the accused, submissions of the learned counsel for the parties and without expressing any opinion on merits of the case, I am of the view that the applicant has made out a fit case for bail.
