Heard learned counsel for the petitioner(s) and learned A.G.A. for the State.
The challenge herein is to a First Information Report dated 07.04.2021 bearing Case Crime No. 0109 of 2021 alleging commission of an offence by the petitioners under Section 2/3 U.P. Gangsters and anti-Social Activities (Prevention) Act, 1986, Police Station- Kandhai, District- Partapgarh.
On a perusal of the First Information Report impugned herein and criminal cases in the gang chart it can not be said at this stage that no offence as alleged is made out against the petitioner(s), therefore, we are not inclined to interfere in the matter.
The writ petition is accordingly dismissed, however, without prejudice to the rights of the petitioner(s) to seek other remedies for enlargement on bail etc. Order Date :- 19.5.2021 R.K.P.
