JUDGMENT / ORDER

Petitioner's passport bearing No.B0014851 has been lost. Petitioner applied for re-issuance of passport. However, while applying for re-issuance of passport, he sought correction of date of birth shown in the passport and also wants to enter the spouse name. It is on account of non consideration, petitioner has approached this Court.
2. Learned Assistant Solicitor General of India has filed a statement on behalf of the respondents 1 and 2. It is stated that details of earlier passport is not available with the authorities. It is further stated that difference in the date of birth is more than 4 years.
3. This Court held in Nizar Vs. Union of India (2014(4) KLT 609) that the Passport Authority can make necessary correction in the entry relating to the date of birth without insisting for obtaining any order from the Court and also the authorities have power to correct the date of birth if the disparity is more than two years. Therefore passport authorities have power to correct the date of birth. Since petitioner seeks correction of W.P(C).No.30340 of 2014N 2 date of birth in the fresh passport, I am of the view that the application can be entertained on being satisfied with the genuineness of the claim put forth by the petitioner. Therefore there shall be a direction to the passport authority to re-issue the passport showing the correct date of birth based on the certificate relied on by the petitioner. If petitioner wants adding spouse name in the passport, he shall also make separate request along with the judgment. Needful shall be done within a period of four weeks from the date of receipt of a copy of this judgment in accordance with law.
The Writ Petition is disposed of as above.
