JUDGMENT / ORDER

Petitioner is the 2nd accused in Crime No.774 of 2014 of the Paravoor Police Station for the offences punishable under Sections 120B, 143, 147, 148, 294(b), 323, 324, 326 and 308 read with Sec.149 of the Indian Penal Code, apprehends arrest and has filed this application. 2. Learned Public Prosecutor has opposed the application.
It is submitted that on 27.04.2014 at about 10.00 p.m, the petitioner and others attacked the de dacto complainant and others with iron rods. Petitioner also used the iron rod. Weapon used by the petitioner is not recovered.
3. Learned counsel submitted that the allegations are not true. It is submitted that petitioner is an eighteen year old +2 student and son of a physically disabled person. It is also submitted that petitioner has no criminal antecedents.
4. I have gone through the CD file and find that there is specific reference to the overt act of the petitioner. The weapon allegedly used is not recovered.

5. Having regard to the nature of the allegations made against the petitioner and the investigation required to be done, request for pre-arrest bail cannot be allowed. It is directed that in case the petitioner is arrested, he shall be produced before the jurisdictional magistrate as early as possible.
Application is disposed of as above.
