JUDGMENT / ORDER

The petitioner approached this Court challenging Ext.P2 bailable warrant of arrest issued by the Lokayukta in complaint No.1060/2013 B. Petitioner raises a question regarding jurisdiction of Lokayukta to entertain the complaint. I am of the view that the objection regarding jurisdiction has to be raised by the petitioner after appearing before Lokayukta. Having not appeared before Lokayukta in spite of notice, Lokayukta is justified in issuing Ext.P2 bailable warrant against the petitioner. However the petitioner undertakes that he will appear before the Lokayukta on the next posting date of 20.10.2014. In view of the above, the petitioner shall appear before Lok Ayukata and raises the objection on complaint on 20.10.2014. After that the Lok Ayukta shall consider the petitioner’s objection regarding jurisdiction and maintainability of the complaint. Till 20.10.2014, the bailable warrant issued against the petitioner will be kept in abeyance. However it is made clear that if the W.P.(C).No.26495 of 2014

petitioner fails to appear before the Lok Ayuktha on 20.10.2014, it is open for the Lok Ayukta to implement Ext.P2 Writ petition is disposed of as above.
