Vide order dated 25th of May, 2012, The District Magistrate/Chairman of District Level Education Committee, Balrampur, was directed to hear the matter after providing opportunity of hearing to the parties.

Learned counsel for the respondent-State informs the court that enquiry report has been furnished by the District Magistrate and consequently respondent no.5 has been removed from service.

Learned counsel for the petitioner contends that the petitioner being the next person in merit in select list needs to be given appointment.

Let respondents file response in regard to the changed circumstances, positively within two weeks from today.
