1. Having regard to the facts and circumstances of the case and the evidence which is discussed by the labour court in the award impugned in present petition and having regard to the decision rendered by the Hon'ble Supreme court in the case between Anoop Sharma vs. Executive Engineer, Public Health Div. No. 1, Paniput reported in (2010) 5 SCC 497 and Harjinder Singh vs. Punjab State Warehousing Corporation reported in AIR 2010 SC 1116, it is not considered appropriate to grant any interim relief to reinstate the respondent. However, only with regard to the direction requiring the petitioner to treat the service of the respondent as continuous for the entire period, it appears appropriate to issue notice to respondent.
2. Hence, office is directed to issue notice to the respondent returnable on 05/03/2012.
