RULE.
There shall be stay of the impugned award qua the direction regarding grant of continuity of service on condition that the petitioner will reinstate the respondent workman within a period of thirty days from today. If the workman is not granted reinstatement within the above period, then the respondent workman shall be at liberty to initiate proceedings under Section 33(c)(2) of the Industrial Disputes Act claiming for back wages as if he was in continuous service. It is however, observed that if the respondent workman attains the age of superannuation, the petitioner shall approach this Court by way of appropriate application.
