The Executive Officer vs S.P.D.Karuppiah

Madras High Court|14 September, 2017

JUDGMENT / ORDER

[Order of the Court was made by K.K.SASIDHARAN, J.] The Review Application is filed by the State to review the order passed by this Court on the ground that there is an error apparent on the face of record.
2. The learned Special Government Pleader appearing on behalf of the petitioner submitted that the Division Bench permitted the petitioner to regulate the holy-dip as it would pollute the water. Thereafter, in paragraph No.5 of the order, this Court permitted the pilgrims to undertake holy-dip, which is contradictory.
3. We have heard the learned counsel for the first respondent.
4. The order passed by this Court clearly indicates that the petitioner was given liberty to regulate the holy-dip. However, in Paragraph No.5 of the order, this Court observed that the petitioner shall permit every one to have their holy-dip. When it is made out that the petitioner is the competent authority to regulate the holy-dip, there is no question of giving a blanket order to the public to undertake holy-dip. We, therefore, clarify the order passed by this Court dated 05 March, 2015, to the effect that the observation made in Paragraph No.5 shall be subject to Paragraph No.4 of the said order.
5. The Review Application is disposed of with the above clarification. No costs. Consequently, the connected miscellaneous petition is closed.
To:
1.The District Collector, Office of the District Collector, Sivagangai District.
2.The Joint Commissioner, Office of the Joint Commissioner, Hindu Religious Endowments Department, Muthusamy Nagar, Sivagangai District.
3.The Tahsildar, Office of the Tahsildar, Karaikudi, Sivagangai District.
