JUDGMENT / ORDER

Petitioner has approached the 2nd respondent by Ext.P9. The petitioner submits that he is practicing Homeopathic Medicine since 1978 after having undergone one year training course and obtaining certificate in Homoeopathy and Biochemistry course. According to the petitioner, though he is not a qualified Homoeopathic medical practitioner, he is entitled to practice Homoeopathy as per Ext.P8 Government Order. According to the petitioner, exemption has been granted under the provisions of Section 38 of the Travancore Cochin Medical Practitioners’ Act, 1953 (hereinafter referred to as ‘TC Act’ for short), for practicing Homoeopathy. 2. Considering the facts and circumstances, the petitioner shall approach the Travancore Cochin Medical Council for seeking exemption under Section 38 of the TC Act. This shall be done within a period of two weeks from the date of receipt of a copy of this judgment. The Travancore Cochin Medical Council shall consider the W.P.(C).No.28835 of 2014 2 application of the petitioner after affording an opportunity of hearing to the petitioner within a further period of two months from the date of receipt of such application.
The Travancore Cochin Medical Council, Near Regional Inistitute of Opthalmology and General Hospital, Near Palayam Airport Road,, Kunnukuzhi, Thiruvananthapuram is suo motu impleaded as the 5th respondent. Till the final decision is taken by the Travancore Cochin Medical Council, no coercive steps shall be taken against the petitioner from practicing homeopathy.
The writ petition is disposed of as above.
